Real estate transactions have been a mainstay of the firm’s practice since its inception. Willman & Silvaggio has excelled at providing solutions to increasingly complex commercial real estate transactions. Our clients are principally financial institutions, builders, developers, small businesses and governmental entities.

Willman & Silvaggio attorneys recognize that the most important component of any successful real estate transaction is the relationship between the parties involved. Frequently, factors such as time constraints, financial exposure and contingent liabilities impact real estate transactions.  Our attorneys strive to protect our clients’ interests, while concluding dealings quickly and cost effectively.  This approach focuses on achieving our clients’ timing deadlines; and, it also minimizes the cost associated with each transaction. In the event that disputes arise during any phase of the transaction – including acquisition and development, land use, zoning, environmental impact, leasing and finance – our attorneys are prepared to negotiate first, and litigate if necessary.

Closing

Willman & Silvaggio attorneys draw upon their years of experience in order to best help our clients in achieving a quick and efficient real estate closing.  Willman & Silvaggio represents the interests of our real estate clients from preliminary negotiations to closing. At the closing, we ensure that all documents are consistent with our clients’ intentions, as well as previously negotiated terms and conditions.  Our attorneys strive to minimize the costs associated with closing, while also achieving our clients’ timing deadlines. 

Land Use and Municipal Regulation

The attorneys of Willman & Silvaggio help to guide their clients through the complex maze of real estate law, including planning, zoning and subdivision use.  Real estate developers are challenged to meet the expectations of investors, tenants and the governmental agencies that oversee the communities in which the development is being created.  Zoning, subdivision and land use regulations have grown to be increasingly elaborate.

Our attorneys appreciate the perplexity of these obstacles, and work with our clients to develop real estate within the regulatory requirements affecting their development.  We also counsel our municipal clients in subdivision matters, zoning and other regulated aspects of development.  Willman & Silvaggio draws upon their years of experience in order to best assist our clients every step of the way throughout this process.

Boundary Disputes

Owning property can often entail disagreements over boundary lines.  These boundary disputes are often the result of antiquated, ambiguous deeds that failed to survey the property or adequately describe the boundaries.  Our attorneys are capable of reviewing our clients’ situations and attempting to negotiate a boundary line that is fair to all interested parties.  If necessary, we will litigate the matters to ensure that our clients’ rights are properly protected.

Liens and Assessments

Willman & Silvaggio represents diverse clients in reviewing and appealing property tax assessments.  We counsel clients that own industrial, commercial and residential properties.  We analyze our clients’ matters to determine where tax savings may be possible, and where over-assessments have been made.  Our attorneys are experienced in negotiating with township assessors and handling appeals before county assessment boards.  The focus is to handle the appeals at the administrative level without necessitating costly litigation.  Nonetheless, if the circumstances warrant litigation, our team of attorneys will aggressively pursue our clients’ interests to reach an appropriate resolution of their matters.

Our firm understands that a slow-moving foreclosure process can be very costly to creditors.  Therefore, our attorneys work to eliminate or reduce the delays associated with this process.  When appropriate, we help our clients by identifying and implementing loss-mitigation measures to present worthwhile scenarios for both our clients and their borrowers.  At the same time, we are mindful of our clients’ rights and assert them to ensure their effective representation.  If necessary, our attorneys will contest matters in litigation; including such issues as the correction of defects that impair titles from transferring at foreclosure.  We also represent clients in counterclaim suits, collections, bankruptcy proceedings and eviction matters.
